Drivers File Multiple Federal Wage Claims Against FedEx Ground

Pulling back the curtain on the contractor scam at FedEx Ground is uncovering a whole lot of possible illegal activity.

In the legal cyclone swirling around FedEx Ground in the multi-district litigation, federal claims are being filed on behalf of drivers to regain their rights and proper compensation.

Three such cases alleging wage claims for present and former FedEx Ground and/or FedEx Home Delivery and/or Adecco USA and/or Kelly Services drivers could reveal another layer of the contractor scam.

In Tidd vs Adecco et al, the plaintiffs allege that drivers who were joint employees of Adecco and FedEx Ground or Kelly Services and FedEx Ground were routinely not paid in full.  They also allege that these joint employees who drove vehicles of gross vehicle weight less than 10,000 lbs were not paid eligible overtime wages since August 2005 under both federal Fair Labor Standards Act and state wage laws.

In Givens vs FedEx Ground, the plaintiffs allege that drivers of vehicles of gross vehicle weight less than 10,000 lbs employed FedEx Ground and FedEx Home Delivery were not paid eligible overtime wages since August 2005 under the federal Fair Labor Standards Act.

In Vargas vs FedEx Ground, the plaintiffs allege that drivers of vehicles of gross vehicle weight less than 10,000 lbs employed FedEx Ground and FedEx Home Delivery were not paid eligible overtime wages since August 2005 under various state wage laws.

That covers potentially a lot of drivers since nearly everyone at FedEx Ground or FedEx Home Delivery started as temps for either Adecco or Kelly.  And there is also probably quite a few drivers still holding onto those vans.
